By the end of this guide

  • Explain how copyright protection differs between images made by AI alone and images a person has worked on.
  • Know what to check in a service's terms and in other people's rights — characters, trademarks, faces.
  • Understand who has to label AI-generated content, and keep a delivery record of how an image was made.

Who this is for

  • Anyone wondering whether generated images can go into client work or ads
  • Anyone who has to set rules for using generated images in a team

What you need

  • Reading "Image prompt basics for designers" first will help.

Theory

Understand what to ask AI to do, how to ask, and the ideas behind the workflow.

  1. Images made by AI alone are hard to protect

A fictional client asks, “We paid for the tool, so only we can use this picture, right?” Permission to use an output and the ability to exclude others are different questions. This exercise prepares a delivery record, not a legal determination for an image.

Copyright protects works that express human thoughts or feelings. So Korea's government says output generated automatically by AI isn't protected, and only the parts where a person added creative expression can be. The U.S. Copyright Office reached a similar conclusion in its January 2025 report: prompts alone aren't enough. It also found that using AI as a tool doesn't, by itself, rule out protection.

Describe the human-authored expression separately. Saving files or resizing them a certain number of times does not establish protection. Preserve originals and records of drawing, arrangement and modification for long-lived assets.

This is general information, not legal advice. Laws differ between countries, and even within one country each case is judged on its facts. For high-value contracts or anything that could end in a dispute, get a legal review.

  2. Each service's terms decide commercial use

Whether you can use a generated image commercially is first a question for the terms of the service you used. Terms differ between services, can differ between plans of the same service, and change over time. Don't rely on what you heard about another service — read the current terms of the one you use.

Even if the terms say the rights to outputs belong to you, that doesn't create a copyright. According to Korean government guidance, even when an AI company hands users all rights to outputs and allows commercial use, the user doesn't gain copyright and can't stop others from reusing the output.

    Check it

    • Is commercial use allowed, and do the same conditions apply to your plan?
    • Who holds the rights to outputs, and are any uses prohibited?
    • Is there a clause where the provider shares responsibility if an IP dispute arises (indemnity), and which plans does it cover?
  3. Make sure you aren't infringing anyone else's rights

Separate from whether your image is protected, the output itself may infringe someone else's rights. AI can produce results that resemble what it learned from, so images close to existing characters or logos do turn up.

Korean government guidance asks users to make sure the text and images they feed into AI don't infringe anyone's copyright, and to take care when sharing outputs. Using a real person's face without permission can raise portrait-rights issues, even when AI made it.

Step-by-step use

Learn what to prepare, how to request help and how to revise the result through examples and explanations.

  1. Record labeling and the actual destination

Do not present a generated shop concept as a photograph of an actual store. Label internal boards in plain language and check whether the explanation survives into the final ad or product page.

Editorial disclosure, legal obligations and platform rules are separate considerations. Review the destination, jurisdiction, service and content type; this lesson does not establish one universal labeling rule.

Record placement, exact wording, policy URL, date and reviewer. If the channel is undecided, leave the review pending. Embedded file metadata alone does not show what an audience understands.

  2. Keep a record of how you made it

Service A, its team plan, dates and image counts below are invented practice data, not an actual terms review. A supplied statement about commercial use does not establish exclusivity or third-party clearance.

What can be protected is the part a person contributed, and if a dispute arises, what you'll need to explain is what you did. Note the tool and plan, the date, the prompt and the human work as you go — it's hard to fill in from memory later.

It's handy to jot rough notes and ask a chat assistant to turn them into a table. Ask it to mark unknown fields "To confirm" so it doesn't invent anything that isn't in your notes.

Notes: background for the autumn campaign poster. Image service A, paid team plan. Generated 2026-10-14; checked the terms the same day — commercial use allowed. Prompt: "misty morning lakeside, wooden boat, watercolor feel, muted colors", aspect ratio 4:5. Made 12, picked no. 7. In Photoshop, redrew the boat and corrected the sky color; added the logo and copy by hand.

    Check it

    • Fill in every "To confirm" field yourself before delivery. If the assistant filled a blank with something plausible, check it against your notes and remove it.
    • Terms can change, so keep a link to or a screenshot of the terms as they stood on the day you checked, alongside the record.

Check & explain

Think about what you would ask AI, then read the explanation. Written submissions and external AI use are optional.

This is a learning check, not a test you must pass. Use the explanations to understand the ideas.

  1. Q1You checked paid-plan commercial use. Can you promise exclusive ownership?

    Write your thoughts (optional)

Your writing is not sent anywhere. It disappears when you leave or reload this page, so copy anything you want to keep.

    Read the answer and explanation

That check does not establish exclusivity. Review usage permission, copyrightability, third-party rights and the rights you can grant separately.

This is your own review, not an automatic score.

  2. Q2The rights-review field was blank, but an assistant filled “cleared.” What should happen?

    Write your thoughts (optional)

Your writing is not sent anywhere. It disappears when you leave or reload this page, so copy anything you want to keep.

    Read the answer and explanation

Remove the unsupported clearance and restore “to confirm.” Require source records, terms and an accountable review before changing the status. Service A is fictional practice data.

This is your own review, not an automatic score.

  3. Q3Can three crops be recorded as proof of human creativity?

    Write your thoughts (optional)

Your writing is not sent anywhere. It disappears when you leave or reload this page, so copy anything you want to keep.

    Read the answer and explanation

Edit count alone does not determine protection. Describe the expression authored or arranged, preserve originals and work records, and assess the scope under the applicable law.

This is your own review, not an automatic score.

Common mistakes

  • Assuming that a paid plan means you own the copyright
  • Putting real people, famous characters or other brands into prompts
  • Keeping no record, so you can't show what a person actually did

Apply to your work

Consider how new material changes the workflow and checking criteria. Trying an external AI tool is optional.

  1. Try it: decide what is ready and what is on hold

Choose an asset from the previous board and fill four lines: input provenance, tool conditions, human edits and destination. Unknown fields are useful findings, not automatic failures.

For a photographed mug composited over a generated background, identify the components. Check the photographer, visible branding and generator terms separately, including permission to upload client-supplied files.

State the scope of readiness. An internal concept review may be ready while a public campaign remains on hold. Update that status only when the responsible reviewer records evidence; filling the checklist does not create permission.

Write a note (optional)

Use this only if you want to record a prompt or your understanding. This is a notebook, not a connected AI assistant.

Your writing is not sent anywhere. It disappears when you leave or reload this page, so copy anything you want to keep.
